The Illinois Power of Attorney Act was amended effective January 1, 2015. The Amendment affects only the Power of Attorney for Health Care. As a part of the Amendment, the Illinois legislature changed the statutory form of the Power of Attorney for Health Care, though a Power of Attorney on the old form remains valid.
The new Power of Attorney for Health Care form is completely different than the one that existed pre-2015. The Amendment and the new POA form have caused substantial controversy among estate planners and Elder Law attorneys throughout the state. As with any new legislation, if you have any questions or concerns, you should discuss them with your estate planning attorney.
