Patrick Hurley was recently appointed by the incoming President of the Illinois State Bar Association to serve on the ISBA Family Law Section Council, whose members include numerous judges and prominent family law attorneys from across the State of Illinois. The mission of the ISBA Family Law Section is (1) to encourage and support a high level of professional and ethical commitment and expertise among those who practice family law in all its substantive branches; (2) to remain sensitive to the changing needs and mores of families and individual family members in our society; (3) to respond, through reasoned efforts directed toward the appropriate branch of government, and bar and /or the public; and (4) to accomplish understanding of the law as it exists and is applied, or change of that law, where it is needed.
In addition, following a hotly contested five-day divorce trial in the Circuit Court of DuPage County, Patrick Hurley’s client was awarded full custody of the parties’ three minor children, the vast majority of the marital assets at issue in the case, and awards of maintenance (alimony) and child support. The case involved complex custody and financial issues, as well as a determination of the invalidity of a postnuptial agreement executed by the parties. The trial featured the testimony of approximately ten witnesses, including the competing expert testimony of two clinical psychologists. Following entry of judgment, the client’s former husband filed an appeal with the Second District Appellate Court, contesting all aspects of the trial court’s decision. In a published opinion, the appellate court affirmed the decision of the trial court in all respects.
Patrick Hurley also recently achieved an out-of-court settlement on behalf of an elderly client who was injured as a result of the negligence of her assisted living facility in conjunction with its transportation of the client and other residents. Following lengthy negotiations with the responsible party’s insurance carrier and the treating hospital (which had asserted a significant lien on the settlement proceeds), Mr. Hurley was able to garner a settlement of $200,000 on behalf of the client, compensating her for her medical expenses and her pain and suffering.
